Terms of Service

1. Acceptance of Terms

By creating an account, accessing, or using Skyvarg (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms form a legally binding agreement between you ("you", "User") and Pawel Bedynski, conducting business activity in Poland under the business name "Pawel Bedynski AI Consulting", with registered office at Magnolii 1, Strzeniowka 05-830, Poland ("Skyvarg", "we", "us"). Skyvarg operates under Polish law, and these Terms are governed by Polish law as described in Section 14.

2. Nature of the Service

Skyvarg provides software that displays, aggregates, and summarizes weather, terrain, airspace, historical flight data, and AI-generated commentary related to paragliding. The Service includes features such as route planning, flight analysis, AI-powered coaching responses, and aggregated content from public sources.

Skyvarg is an informational tool only. Skyvarg is not intended for emergency use, real-time collision avoidance, or operational decision-making while in flight. You must not rely on the Service as your primary or sole source of information during takeoff, flight, landing, or any emergency.

Skyvarg is not:

• A flight instructor or certified flight instruction service
• An official weather forecasting service
• An official airspace advisory service
• A safety decision-making authority
• A replacement for the pilot's independent judgment and training

Skyvarg is not certified, approved, or endorsed by any aviation authority, meteorological authority, or air navigation service provider unless expressly stated otherwise.

Your use of the Service does not create any instructor-student, professional advisory, fiduciary, safety-monitoring, rescue, or air-navigation relationship between you and Skyvarg.

All flight decisions, including whether to take off, where to fly, when to land, and how to respond to conditions, are solely and exclusively the pilot's responsibility.

Skyvarg does not provide aviation, accident, rescue, medical, liability, equipment, or any other insurance coverage.

3. Eligibility and Pilot Qualifications

To use Skyvarg for flight-related features, you represent and warrant that:

• You are at least 18 years of age, or the legal age of majority in your jurisdiction
• You hold all licenses, ratings, and certifications required by your national aviation authority to operate a paraglider or hang glider
• You maintain current knowledge of flight regulations, airspace restrictions, and safety protocols applicable to your flying
• You will not rely on Skyvarg as a substitute for proper flight training, instruction, or supervision
• You are physically and mentally fit to fly
• You are solely responsible for determining whether you are legally permitted and sufficiently trained to undertake any flight, and for complying with all local laws, regulations, site rules, and airspace restrictions.

4. Assumption of Risk

Paragliding, hang gliding, and other free-flight activities are inherently dangerous and can result in serious injury, permanent disability, or death. You acknowledge and agree that:

• Risks include, without limitation: equipment failure, inaccurate weather information, turbulence, wind shear, collisions, terrain hazards, lightning, icing, physiological effects of altitude, pilot error, and many other factors
• No weather forecast, AI output, airspace database, terrain model, or flight suggestion is guaranteed to be accurate, complete, or current
• Skyvarg's historical flight data, community content, forum excerpts, and AI-generated summaries and warnings may contain errors, outdated information, or interpretations that do not apply to your specific situation
• Conditions in the air change faster than any app can update
• You are the pilot in command and bear full responsibility for every flight decision
• You acknowledge that the Service may be unavailable, delayed, incomplete, inaccurate, or non-functional due to connectivity issues, device limitations, sensor errors, third-party outages, software defects, battery failure, background app restrictions, or other causes, including at critical moments
• You further acknowledge that local and terrain-driven conditions may differ materially from generalized forecasts, historical patterns, or app-generated outputs

You voluntarily assume all known and unknown risks associated with your flying and other activities, whether or not Skyvarg was used in preparation for or during the activity, and EVEN IF THOSE RISKS ARE CAUSED IN WHOLE OR IN PART BY THE ACTION, INACTION, OR NEGLIGENCE OF SKYVARG OR BY THE ACTION, INACTION, OR NEGLIGENCE OF OTHERS.

5. Release of Liability and Promise Not to Sue

To the fullest extent permitted by law, you release, waive, and discharge Skyvarg, its owners, employees, contractors, affiliates, data providers, and agents (the "Released Parties") from any and all claims, demands, liabilities, damages, losses, costs, and expenses (including attorneys' fees) of any kind, whether known or unknown, anticipated or unanticipated, and you further promise not to sue the Released Parties for any such claims, arising out of or related to:

• Your use of or inability to use the Service
• Your reliance on any information, forecast, suggestion, AI output, or content provided by the Service
• Any flight, takeoff, landing, or other activity undertaken with or informed by the Service
• Any injury, death, property damage, or other harm to you or any third party
• Any error, omission, delay, outage, or inaccuracy in the Service

This release and promise not to sue applies to claims based on negligence (to the extent permitted by law), breach of contract, strict liability, or any other legal theory, and applies regardless of whether Skyvarg was aware or should have been aware of any risk.

Unknown Claims Waiver

You acknowledge that this release extends to claims that you do not know or suspect to exist at the time of agreeing to these Terms. You expressly waive the benefits of any law of any state, country, or territory that would preserve such unknown claims, including without limitation California Civil Code Section 1542, which provides:

"A general release does not extend to claims which the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party."

You understand that by waiving the protections of §1542 and similar laws, you are releasing Skyvarg from claims that you may not currently be aware of and that you may not discover until after you agree to these Terms.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SKYVARG AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST DATA, PERSONAL INJURY, WRONGFUL DEATH, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF SKYVARG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL SKYVARG'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID TO SKYVARG IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED EUROS (€100).

This limitation applies regardless of the legal theory on which the claim is based and regardless of whether Skyvarg was negligent, breached the contract, or violated any other duty.

The limitation in this Section applies in the aggregate to all claims, causes of action, losses, and theories of liability arising from or relating to the Service, including claims based on contract, tort, negligence, strict liability, statute, or otherwise.

7. Time Limitation on Claims

Any claim you may have arising out of or related to your use of the Service or these Terms must be filed within one (1) year after such claim arose; otherwise, your claim is permanently barred. This provision does not apply if you are a consumer residing in the European Union, in which case time limitations shall be determined in accordance with the governing law described in Section 14.

8. Indemnification

You agree to indemnify, defend, and hold harmless Skyvarg, its owners, employees, contractors, affiliates, and agents from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to your use of the Service, your violation of these Terms, your violation of any applicable law or regulation, your violation of any third-party right, or any flight or activity undertaken by you. This includes claims arising from your uploaded content, your flight conduct, your violation of airspace or site rules, your misuse of the Service, and any claim by passengers, spectators, landowners, site operators, clubs, instructors, event organizers or governmental authorities arising from your activities.

9. No Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED.

Skyvarg expressly disclaims all warranties including, without limitation, warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, timeliness, and availability.

Skyvarg does not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Weather forecasts or satellite data will be accurate or timely
• Airspace or terrain data will be current or complete
• AI-generated responses will be accurate, appropriate, or suitable for any specific purpose
• Route analyses and comments or flight analyses will be safe or advisable
• Any defects in the Service will be corrected

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Third-Party Data and Content

Skyvarg aggregates, displays, and processes data from third-party sources including weather services (EUMETSAT, Open-Meteo, national meteorological agencies), terrain providers, airspace databases, public forums, and other sources. Skyvarg does not control this data and makes no representation about its accuracy, completeness, or fitness for any purpose.

AI-generated content ("AI Coach", flight analysis, summaries) is produced by large language models that may produce inaccurate, outdated, or misleading responses. AI outputs are not vetted by human experts and must not be used as the sole basis for any flight decision.

Historical, forecast, terrain, airspace, and AI-derived outputs may be incomplete, stale, simplified, interpolated, generalized, or wrong, including in ways that are not obvious to the user.

Certain features may be marked as beta, experimental, preview, or similar. Such features may be incomplete, unstable, inaccurate, withdrawn at any time, and subject to additional limitations.

The Service cannot account for all site-specific, micro-meteorological, terrain-induced, launch-specific, landing-specific, or rapidly changing local conditions. Local observation, training, official sources, and your own judgment remain essential.

11. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Interfere with or disrupt the Service or its servers
• Attempt to access another user's account
• Reverse engineer, decompile, or attempt to extract source code
• Use automated means (bots, scrapers) to access the Service without written permission
• Upload malicious code or attempt to compromise the security of the Service
• Misrepresent your identity, qualifications, or flight data
• Use the Service to harass, threaten, or harm others

12. User Content

If you upload flight tracks (IGC files), photos, comments, or other content ("User Content"), you retain ownership but grant Skyvarg a worldwide, non-exclusive, royalty-free license to use, store, display, modify, and process that content for the purpose of operating and improving the Service. You represent that you have the right to upload any User Content and that it does not violate any law or third-party right.

You are solely responsible for obtaining any permissions, consents, or other rights necessary for any User Content you upload, including content involving third parties, shared flights, or third party data.

13. Subscription and Payments

Paid features are billed in advance on a monthly or annual basis through our payment processor (Stripe). Subscriptions renew automatically until cancelled. You may cancel at any time through your account settings; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except where required by law. Prices, features, and tier limits may change with 30 days' notice.

14. Dispute Resolution and Governing Law

Good-Faith Negotiation Precondition

The parties shall use their best efforts to settle any dispute, claim, question, or disagreement directly through good-faith negotiations. Good-faith negotiation shall be a precondition to either party initiating a lawsuit or arbitration. To initiate this process, contact us at hello@skyvarg.ai with a description of the dispute. If the dispute is not resolved within thirty (30) days, either party may proceed as set out below.

Governing Law

These Terms are governed by the laws of Poland, without regard to conflict of law provisions. Skyvarg is operated in Poland by Pawel Bedynski, in the course of registered business activity.

Users in the European Union, United Kingdom, and other jurisdictions outside the United States

Any dispute shall be resolved exclusively in the competent courts of Warsaw, Poland. Nothing in this section limits consumer rights that cannot be waived under applicable mandatory law, including protections available to consumers under EU consumer protection directives.

Users Residing in the United States

You and Skyvarg agree that any dispute arising from or related to these Terms or the Service shall be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small claims court if eligible. This dispute resolution provision is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1 et seq., which preempts any state law to the contrary.

The arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration shall be conducted by video conference. In-person hearings will only be held if requested by the consumer, at a location reasonably convenient to the consumer, and subject to the arbitrator's approval.

YOU AND SKYVARG EXPRESSLY WAIVE THE RIGHT TO TRIAL BY JURY and understand that arbitration is a private dispute resolution process without a jury.

You and Skyvarg agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding, including any private attorney general, collective, or consolidated proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If the class action and representative-action waiver is found to be unenforceable as to any particular claim or remedy, then that claim or remedy (and only that claim or remedy) shall be severed and may be brought in court, while all other claims shall remain subject to this arbitration provision. If the class action waiver as a whole is found unenforceable, then the entire arbitration provision shall be null and void.

Opt-Out. You have the right to opt out of this arbitration agreement by sending written notice to hello@skyvarg.ai within thirty (30) days of first accepting these Terms. If you opt out, disputes will be resolved in the courts of Warsaw, Poland as described above.

15. Account Termination

We may suspend, restrict, or terminate access to the Service if you violate these Terms, create safety, legal, operational, reputational, or technical risk, misuse the Service, expose us or others to liability, or if continued provision of the Service becomes impracticable. You may terminate your account at any time by contacting hello@skyvarg.ai.

Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Assumption of Risk, Release of Liability, Unknown Claims Waiver, Limitation of Liability, Time Limitation on Claims, Indemnification, and Dispute Resolution) will survive.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. Each version of these Terms is timestamped, and we keep a record of which version you accepted and when.

17. Miscellaneous

• Entire agreement. These Terms, together with our Privacy Policy and Risk Acknowledgment, constitute the entire agreement between you and Skyvarg.
• Severability. If any provision is held unenforceable, the remaining provisions remain in full force.
• No waiver. Our failure to enforce any provision does not waive our right to enforce it later.
• Assignment. You may not assign these Terms. We may assign them to a successor or acquirer.
• Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
• Section titles. Section titles and headings are for convenience only and have no legal or contractual effect.
